General Terms & Conditions XXL Flag Online Auction 2026
General
These General Terms and Conditions (“Terms and Conditions”) apply to the online auction whereby one (1) XXL Tomorrowland Flag signed by various artists performing at Tomorrowland Belgium 2026 is offered to the public (“Online Auction” and the “Product”)).
The organizer of the Online Auction is WEAREONE.world Lifestyle bv, with registered offices at Kattendijkdok-Westkaai 12, box 001, 2000 Antwerp, Belgium and registered with the Crossroads Bank of Enterprises under number (the “Organizer”), alone or together with a partner or a third party on the Organizer’s behalf.
The purpose of the Online Auction is to raise funds in support of the Tomorrowland Foundation. Subject to applicable taxes, payment processing fees, shipping costs and any other costs directly related to the organization and completion of the Online Auction, the proceeds generated through the Online Auction shall be donated by the Organizer to the Tomorrowland Foundation.
By entering the Online Auction, the bidding entrant (the “Bidder”) acknowledges having read, understood and fully accepts these Terms and Conditions, which can be consulted on the Organizer’s website, together with any specific instructions and terms applicablt to the Online Auction which may be communicated electronically, published on the Organizer’s website or otherwise communicated to the Bidder.
The Organizer reserves the right, in its sole discretion, to amend, supplement, suspend, postpones or terminate the Online Auction and/or these Terms and Conditions at any time where reasonably justified by operational, legal, technical, security or force majeure considerations. and will keep the Oganizer adequately informed.
The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any enforceability of any other provision. Any invalid provision shall, to the extent permissible by law, be replaced by a valid provision that most closely reflects the original intent of the parties.
Entry to the Online Auction
Participation in the Online Auction is only possible for persons who hold a valid Tomorrowland Account and are logged into such account when placing a bid.
The Bidder may register in their own name or, where applicable, in the name of their company through the platform available at https://store.tomorrowland.com
The Online Auction is open to natural persons of all nationalities who have reached the age of majority in their country of residence and who have the legal capacity to enter into binding agreements.
The Bidder confirms that all information provided to the Organizer is true, complete and accurate.
Upon participation in the Online Auction, each Bidder unconditionally accepts these Terms and Conditions.
Every bid submitted through the Online Auction constitutes a binding, irrevocable and unconditional offer to purchase the Product at the amount of such bid.
A submitted bid cannot be withdrawn, cancelled or modified after submission.
The highest valid Bidder at the close of the Online Auction shall be designated as the buyer of the Product (the “Buyer”) and shall be legally obliged to complete the purchase of the Product in accordance with these Terms and Conditions.
The Buyer acknowledges that the Product is a unique item auctioned through a competitive bidding process and that the sale relates to a unique collectible item for charitable purposes. To the fullest extent permitted by applicable law, no statutory right of withdrawal shall apply.
The Organizer reserves the right to reject, invalidate or cancel bids in the event of fraud, abuse, bad faith, technical manipulation, breach of these Terms and Conditions or any circumstance affecting the integrity of the Online Auction.
In the event of any dispute relating to the conduct of the Online Auction, the validity of a bid, the identification of the highest bidder, technical issues or any other matter affecting the Online Auction, the Organizer shall determine the appropriate course of action acting reasonably and in good faith. The Organizer may, without being required to provide justification, reject bids, invalidate bids, suspend the Online Auction, re-open bidding, allocate the Product to another eligible bidder, cancel the Online Auction or take any other measure reasonably required to safeguard the integrity of the Online Auction. The Organizer's decision shall be final, except in cases of manifest error, fraud or wilful misconduct.
Duration
The Online Auction opens on 10 September 2026 and closes on 27 September 2026, or any other date(s) as decided and communicated by the Organizer.
Any entry or bid received before the opening or after the closing of the Online Auction will be invalid and will not be entered into the Online Auction. The electronic records maintained by the Organizer shall serve as evidence of the timing and validity of bids submitted.
Payment
The Buyer shall pay the purchase price no later than three (3) calendar days after receipt of the second confirmation email converting the winning bid into a binding sale.
The purchase price shall consist of the winning bid amount, increased with any VAT, shipping costs, custom duties, import charges and any other applicable taxes or levies.
The Buyer shall be solely responsible for all import duties, customs formalities, local taxes, permits and regulatory requirements applicable in the country of destination.
The payment method and practical payment instructions shall be communicated to the Buyer following the closure of the Online Auction.
Timely payment is essential. Should the Buyer fail to make payment within the prescribed period, the Organizer may, without prejudice to any other rights available under applicable law (i) terminate the sale (ii) award the Product to the next highest eligible Bidder, (iii) re-organize the Online Auction for the Product and/or (iv) recover damages, losses, costs and expenses suffered as a consequence of the Buyer’s fault.
The sale shall become final upon receipt of the full purchase price by the Organizer.
The Organizer reserves the right to refuse, suspend or cancel any transaction where reasonably required to comply with applicable sanctions legislation, anti-money laundering laws, fraud prevention requirements or other legal obligations.
Nature of the Product
The Product consists of one unique XXL Tomorrowland Flag signed by various artists.
The Product is sold in its existing condition ("as is").
The Organizer makes no representations or warranties with respect to: (i) the future value of the Product, (ii) its collectability or resale potential, (iii) the future condition of the Product; and (iv) the continued visibility, preservation or legibility of any signature appearing on the Product
References to artist signatures are provided in good faith on the basis of information reasonably available to the Organizer.
Due to the unique nature of the Product, all sales are final and, except where mandatory law provides otherwise, the Product cannot be returned, exchanged or refunded following completion of the sale.
Privacy
By submitting personal data, the Bidder agrees to the processing of such personal data for purposes connected with the Online Auction
The Organizer shall process personal data in accordance with applicable data protection legislation, including the General Data Protection Regulation (EU) 2016/679 and with the Organizer’s privacy policy available at tomorrowland.com/privacy.
Intellectual property rights
Nothing in these Terms and Conditions transfers any intellectual property rights owned by the Organizer, Tomorrowland, the Tomorrowland Foundation or any third party.
The Buyer may share images of the Product on social media for personal and non-commercial purposes, provided that such use does not suggest sponsorship, endorsement or affiliation beyond the Buyer's lawful ownership of the Product..
Unless the Buyer objects in writing, the Organizer may publish the first name, country of residence and winning bid amount of the Buyer for purposes related to the communication of the fundraising initiative.
Liability
To the maximum extent permitted by applicable law, the Organizer and any third parties (directly of indirectly) involved in the organization of the Online Auction shall not be liable for any indirect, incidental, consequential or special damages arising out of or in connection with the Online Auction.
The Organizer reserves the right to modify, revise, interrupt, suspend, cancel or postpone the Online Auction in case of Force Majeure or circumstances beyond its reasonable control, including technical failures, cyber incidents, governmental measures or legal restrictions, without any liability towards Bidders.
Printing, typographical, administrative, technical or system errors shall not give rise to any claim against the Organizer.
The Organizer shall not be liable for loss, theft, delay or damage occurring during transport or delivery by postal operators, couriers or logistics providers.
The Buyer shall be responsible for any damages caused by the Buyer's actions in connection with the collection, receipt or use of the Product.
The Organizer shall not be responsible for incorrect information supplied by the Bidder.
Nothing in these Terms and Conditions shall exclude or limit liability which cannot legally be excluded or limited under mandatory provisions of Belgian law.
Communication and disputes
No communication shall take place regarding the Online Auction other than communications expressly provided for in these Terms and Conditions or otherwise initiated by the Organizer.
These Terms and Conditions, the Online Auction and all disputes arising out of or in connection therewith shall be governed exclusively by Belgian law, excluding the rules of Belgian private international law and exclusign the Inited Nations Convention on Contracts for the international sale of goods. Nothing in these Terms and Conditions shall deprive a consumer of any mandatory consumer protection provisions applicable under the laws of the country in which such consumer habitually resides.
Any dispute concerning the existence, interpretation, execution or the Online Auction and these Terms and Conditions shall fall within the exclusive jurisdiction of the courts of Antwerp, Belgium.
